That's a very old and lame argument. I have conceded that there is no such thing as privacy in a public place, but this raises a whole new category of privacy through use of the image. In this there is a mild suggestion that there has been some kind of wrongdoing by the person whose image has been, ahem, captured.
Then there is the question of on going survelance and where is the right of the individual.
