Default 11th Circuit Court of Appeals Rules Against Obama Healthcare Law

This is a big one folks...

The Appeals Court for the 11th Circuit, based in Atlanta, found that Congress exceeded its authority by requiring Americans to buy coverage, but also ruled that the rest of the wide-ranging law could remain in effect.

The legality of the so-called individual mandate, a cornerstone of the healthcare law, is widely expected to be decided by the U.S. Supreme Court. The Obama administration has defended the provision as constitutional.

This gets better and better... looks like the one and only thing Obama might have to brag on will be declared unconstitutional right in time for next year's election.

Obamacare is nothing to brag about, that is a loser for him. Now with the appeals court saying it's unconstitutional by I believe leftist Judges is another nail in Obamcare.

So this is what now....2 decisions against all or part and 3 for?

I don't know when SCOTUS will get it but that's the one that will count.

In the meantime, I'm curious as to what kind of tom foolery these idgets will come up with for their alternative. I'm concerned that the next iteration will be even worse than this one was.

Your giving Obamacare way too much credit.

SCOTUS seems it will be getting it in the near future,

"The split rulings make the suit a strong contender to be taken up by the Supreme Court in the fall term.
The Thomas More Law Center, which lost the 6th Circuit ruling, has already filed its appeal.
The federal government will have 90 days to appeal to the Supreme Court or ask the entire 11th Circuit to review the ruling."

Just one step closer to getting this in front of the supreme court just in time for the next election, should keep things interesting this time next year.

Lets just hope this is the direction the courts keep going.

Otherwise we're going to get stuck with this crap forever.

If the supreme court gets it before the end of the yr, I would think there would be a ruling before the 2012 election.

This is the most surprising aspect of the ruling.

[QUOTE]The 2-1 ruling marks the first time a judge appointed by a Democrat has voted to strike down the mandate. Judge Frank Hull, who was nominated by former President Bill Clinton, joined Chief Judge Joel Dubina, who was appointed by George H.W. Bush, to strike down the mandate.

Judge Stanley Marcus, in a dissenting opinion, said the mandate is constitutional. He was also appointed by Clinton.

In the meantime it's a cliff hanger at SCOTUS and this could as easily be overturned as upheld.

I'm not following you. This is just the process that cases go through. A Federal case starts in a circuit court then goes through appeals before SCOTUS can consider it.
