I question the above:
A worker has the right to reject being under workers compensation and I would think free to sue anyone if there was no law to the contrary.
I believe if they accept Workers Comp. the case may be they cannot sue.
The law was set up that way to allow for use of contract workers on a providers payroll without the liability of injury or death of the worker.
As a practical matter we would probably not hire a person who rejected the insurance without telling a user the person was uninsured. Of course the user would quickly dump the person.
