Further, this kangaroo court we're holding in Baghdad....... if we were going to try him anywhere, it should have been before a world body, not the "new government of Iraq" which the arab world (and the rest of it too) knows is merely a proxy for the United States.
Why dont you think that the iraqi people should not have first dibs on him?

On Monday, Saddam's lawyers repeated [Reuters report] an earlier call [JURIST report] to have Hussein's trial venue moved to a location outside of Iraq, saying that they are risking their lives by remaining in the country, especially after a defense lawyers for one of the former Iraqi dictator's co-defendants was murdered [JURIST report] last month. The defense team has threatened not to cooperate [JURIST report] with the Iraqi Special Tribunal [official website] trying Hussein until security is strengthened as promised by the Iraqi government [JURIST report], or the trial is moved out of the country. Saddam hasn't committed any crimes under the new constitution, which doesn't exist yet.

Even if you scrap what is still the current constitution that Hussein himself put in, you would go back to the constitution of 1957, which also exempted the president from prosecution.

From a strictly legal perspective, Saddam is innocent. Unless you can find a crime he committed before he was President, and witnesses willing to testify.

1) I don't think the court WE'VE set up in Baghdad represents "the Iraqi people." It represents the United States.

2) Crimes against humanity are crimes not only against the Iraqis but the entire world. These crimes, since Nuremberg have been tried by world bodies.
